Alternative Dispute Resolution Service
HMRC’s alternative dispute resolution service seems to be one of its best kept secrets. Following a successful opening trial in certain regions, the trial has now been extended nationwide.
The service offers an arbitration-based means of attempting to resolve a tax dispute, as an alternative to taking a case to Tribunal. There is no doubt that arbitration is a good, well recognised and very valuable form of dispute resolution. The sceptics amongst us had doubts when it was set up about the independence of the service. Apparently, those few practitioners who have used the service have been very pleased with it. If you have dismissed it, it may be worthwhile having another look.
You can see HMRC’s examples of suitable cases for the Alternative Dispute Resolution pilot on the website.
Please email ACCA and let use know if you have used the service and how you found the process.
